The protection of your privacy in processing your personal data and the security of this data are very important to EMCV Management Consulting GmbH (hereinafter referred to as: EMCV).
All the information which is about an identified or identifiable natural person (hereinafter referred to as “Person concerned”), is considered to be personal data (hereinafter referred to as “Personal data”). This includes, for example, your name, your phone number, your postal address or your email address.
EMCV handles personal data which is collected during your visit to the website or in the scope of a contractual relationship, in a confidential manner and in accordance with the respective applicable data protection regulations.
As a user of the website, EMCV would like you to understand how EMCV uses the information and what you can do to protect your data.
In this data privacy statement you will find out which personal data is collected by EMCV, the purposes for which EMCV collects the data and how EMCV uses the collected data.

2. Data processing in the framework of performance of the contract
We process all the information that you disclose to us as a customer for the implementation of pre-contractual measures and upon conclusion of a contract.
Your data is automatically processed (e.g. email correspondence) in the scope of our business relationship in the form of archived text documents (e.g. correspondence, contracts, personalised invoices), in order to implement the pre-contractual measures and to be able to perform the contract. Processing is also done for marketing purposes.
Data is processed on the basis of Art. 6 para. 1 lit. b GDPR (contract initiation and contract performance). To be able to fulfil the contractual obligations incumbent on us, processing the data provided by you is absolutely necessary. For marketing purposes, data is processed in some cases on the basis of Art. 6 para. 1 lit. f GDPR (legitimate interest) and on the basis of the Telecommunications Act (TKG).
3. Collecting data / Usage of Cookies
3.1. Collection of personal data when you visit our website
If the website is used only for informative purposes, EMCV only collects the personal data which is sent by your browser to the server of EMCV. We only collect the following data which we technically require to display our website to you and to ensure stability and security.
3.2. Cookies
3.2.1 What are Cookies?
Cookies are small text files, which are saved by a website to the device of the user. Several Cookies contain a so-called Cookie-ID. A Cookie-ID is a unique identifier of the Cookies. It consists of a string, through which websites and servers can be assigned to the actual internet browser, in which the cookie was saved. This enables the visited websites and servers to distinguish the individual browser of the person concerned from other internet browsers which have other cookies. A particular internet browser can be recognised and identified with the unique Cookie-ID.
By using Cookies, EMCV can provide you with user friendly services, which would not be possible without installing Cookies.
With a Cookie, the information and offers on the website can be optimised for the user.
3.3. Which Cookies are installed by EMCV?
3.3.1 Google Analytics
We use the functions of the web analysis service Google Analytics. It is provided by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.
Google Analytics uses goal-oriented Cookies.

3.3.2 Google Maps
We use Google Maps to show maps. It is provided by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. By using this website, you give permission to Google, one of its representatives, or a third party service provider, to collect, process and use the automatically collected data and the data given by you.

3.3.3 Session Cookies
EMCV uses Session Cookies, which are absolutely necessary for functional purposes when the website is used. Session cookies store a so-called Session-ID with which different requests of the browser can be assigned to the joint session. In this way, your computer can be recognised when you return to the website of EMCV. After the completion of every session (leaving the website), the data collected in this duration about you is deleted.
3.3.4 Functional restrictions without Cookies
If you do not allow EMCV to use Cookies, certain functions and pages do not work as expected.
You can delete Cookies that are already in your computer at any time. The process for deleting Cookies differs depending on the browser, for more information please see the browser guide (under “Help” in the browser menu).
As a responsible company, EMCV does not do automated decision-making or profiling.
4. Visiting cards
If you have given us visiting cards during events, we add the personal data given on your visiting card to our contact records and process it in the scope of initiation/handling of a business relationship with you.
5. Usage of the data collected by EMCV
EMCV uses the data collected in the scope of its services, for providing, maintenance, protection and improvement of services, for developing new services and for protecting EMCV and its users.
Before EMCV uses the information for any other purpose than the purposes mentioned in this privacy statement, EMCV will ask for your permission.
EMCV processes personal data on its servers that are located in Austria.
5.1.1 In the framework of performance of the contract
In the framework of performance of the contract, the data which is disclosed to us by you or which is disclosed in the scope of the contractual relationship, is forwarded to third parties who are involved in performing the contract.
Similarly, your data is also sent in some cases for accounting and billing purposes to tax consultants, to an external accounting department or to authorities.
If this is required, EMCV signs job processing contracts with the respective processors.
6. Contacting us
If you contact EMCV via email, the data sent by you is saved by EMCV to respond to your queries. The data required for this may be forwarded to the processors for provision of services. EMCV does not sell your data to third parties, nor is it otherwise marketed. EMCV deletes the data processed in this connection when storing it is no longer necessary, or limits the processing if there are legal obligations to retain information.
7. Data security
EMCV works hard towards ensuring that it and its users are protected from unauthorised access or from unauthorised changes, transfer or destruction of data. Especially in the following ways:
EMCV encrypts many of its services with SSL/TLS.
EMCV reviews its practices for collecting, saving and processing data, as well as the physical security measures taken for preventing unauthorised access to systems.
EMCV restricts the access to personal data by the employees and the contractors of EMCV, who need the data to process this data for EMCV, and are subject to strict confidentiality obligations and who have to face disciplinary actions, administrative penalties and/or criminal consequences, if they do not comply with these obligations.
8. Data subject rights
Owing to the statutory data protection provisions, you have extensive rights related to your data. You can exercise these rights by sending an email to office@emcv.at. These rights specifically include:
8.1. Right to information
Upon request, EMCV shall provide you with information within the legally stipulated period, about the data categories saved with EMCV about you, about the purposes of processing and the recipients of your personal data. In case of doubt, EMCV demands a proof of your identity, before EMCV can comply with this obligation.
8.2. Right to correct
You have a right vis-à-vis EMCV to get your personal data corrected, changed or amended at any time. In some cases, EMCV demands a proof of your identity, before EMCV can comply with this obligation.
8.3. Right to data portability
You have the right, as far as it is technically possible, to get all the data saved about you with EMCV transferred to another company.
8.4. Right to delete
At your request, EMCV shall delete all the personal data about you which is saved with EMCV, within the legally prescribed period. If there is a legal obligation to store data, it is deleted only after this period is over. This data is blocked internally for further use.
8.5. Right to limit the processing
You have the right to demand that EMCV must limit the processing of personal data, if one of the following pre-requisites is met:
If you contest the correctness of the personal data and that too for a duration which allows EMCV to review the correctness of the personal data,
the processing is unlawful and you reject the deletion of personal data and instead demand that the use of the personal data must be limited,
EMCV does not need the personal data for the purpose of processing any longer, but you need it to assert, exercise or defend legal claims, or
If you have raised an objection against the processing and till it is clear if the legitimate reasons of EMCV outweigh your reasons.
8.6. Right to object
As far as data is processed for legitimate interests, you have the right to raise an objection against the processing. Any objections against data processing must be sent to office@emcv.at.
9. Revocation
You can revoke your permission, either partly or fully, for collecting and processing your personal data, at any time with effect for the future. Till the revocation is effective, your personal data is processed legally. In this case, EMCV shall immediately delete your data to the extent that you demand or block it for further use. 10. Storage
Your data is saved till it is required for providing services. If the data has to be stored for a longer duration because of legal provisions, then the data is stored till the legally prescribed period is over.
11. Copyright
The contents of our website, especially the products shown and the data given there are protected by copyright. The contents may not be reproduced and/or published or saved in an information system, whether fully or partially, without the prior written approval. The representation of this website in third party frames is permitted only after getting an express written consent for it.
12. Scope of application of the data privacy statement
The data privacy statement is applicable only for the website of EMCV and in the context of the contractual relationship.
The data privacy statement is not applicable for services, which are offered by other companies or persons, including products or websites, that are shown to you in search results, websites that may include services of EMCV, or other websites linked with services of EMCV. The data privacy statement does not cover handling of information shown by other companies or organisations, who advertise services and possibly use Cookies, Pixel-Tags and other technologies, in order to show and offer the relevant advertisements.
Similarly, the websites and links that are linked on our website or are provided on our website are not covered by the data privacy statement.

The data privacy statement may change from time to time. All changes that are made to the data privacy statement shall be published on this website.
